1. Acceptance of these Terms

By creating an account or otherwise using Dead Man's Switch (the "Service"), you agree to these Terms & Conditions. If you do not agree, do not use the Service.

2. What the Service does

The Service lets you upload documents and designate recipients. You confirm you are safe and well by checking in periodically. If you stop checking in for longer than your chosen grace period, the Service sends reminders and, if check-ins still don't resume, proceeds according to your escalation policy — which may include releasing documents to the recipients you designated. Any release to a social or public channel is held for review by our trust & safety team before delivery.

3. Two separate credentials

Your account uses two distinct credentials: a LOGIN password (protected by TOTP two-factor authentication) that manages documents, recipients, and policy; and a separate check-in PIN used only to perform a RESET (check-in). The PIN can never view or change your documents, recipients, or policy. You are responsible for keeping both confidential.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.

5. Your responsibilities

• Keep your login credentials, check-in PIN, and authenticator device secure.
• Check in within the interval required by your chosen policy.
• Ensure you have the right to upload and share any document you store with us.
• Keep recipient contact details accurate and up to date.
• Do not use the Service to store or distribute unlawful, infringing, or harmful content.

6. No guarantee of timing or delivery

The Service is provided on a best-effort basis. While we operate a scheduler and reminder system, we do not guarantee that reminders or releases occur at an exact moment, or that any given notification channel (email, webhook, or portal invite) will always be delivered successfully. The Service is not a substitute for a will, trust, or other formal legal or estate-planning instrument, and should not be relied on as your sole means of ensuring critical information reaches someone.

7. Plans & billing

Paid plans are billed on the interval shown at checkout. You may upgrade, downgrade, or cancel from your account's billing page at any time; changes take effect according to the terms shown there at the time.

8. Suspension & termination

We may suspend or terminate accounts that violate these Terms, misuse the Service, or pose a risk to other users, with or without notice where reasonably necessary.

9. Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
